Swapdeck

Terms and conditions

1. The service and who provides it

Swapdeck is operated by Duemar International FZ-LLC, Compass Building, Al Hamra Industrial Zone-FZ Ras Al Khaimah, United Arab Emirates ("we"). Contact: support@swapdeck.top.

Swapdeck lets playlist curators, labels and artists manage Spotify playlists, exchange playlist placements with other members ("swaps") and track how releases perform. By creating an account you agree to these terms. The version you accepted and the date are stored with your account.

2. Your account

You must be at least 16 years old, give accurate details and keep your password and two-factor codes private. You are responsible for activity on your account. Tell us promptly if you believe someone else has access to it.

3. Connecting Spotify

When you connect a Spotify account you authorise the service to read your playlists and to add, move and remove tracks in the playlists you choose to manage here, as needed to carry out the actions you take and the swaps you accept. You can revoke this at any time from your profile or from your Spotify account settings. You must have the right to manage the playlists you add, and you remain responsible for following Spotify's own terms and guidelines when you use them.

4. Swaps between members

A swap is an agreement between two members. The service records it and carries it out on your behalf, without a further confirmation each time: it places the agreed songs in the agreed playlist positions when the swap starts, checks every day that they are still there, moves a song back when it was pushed below its agreed position, and removes the songs when the swap ends or is cancelled. A swap in which one side's song stays missing is ended automatically. We are not a party to the swap and do not guarantee any number of listeners, streams or followers.

Numbers shown as "Estimated listeners" are estimates calculated from followers and position. Numbers shown as "Measured streams" come from Spotify for Artists when the artist gave Reader access; they can arrive late and can be incomplete. Neither is a promise.

You may not sell placements, ask for payment for a placement, or use the service to generate artificial streams.

5. Acceptable use and moderation

Do not harass other members, send unsolicited advertising, impersonate others, upload content you have no right to share, attempt to access data belonging to other members, or interfere with the operation of the service. You can block a member and report them to us from their profile or from a conversation. When we receive a report, or find a breach ourselves, we may remove content, suspend messaging, end swaps or close the account. We tell the member concerned what we did and why, and they can ask us to review the decision by writing to the contact address above.

The "verified" badge is awarded automatically for a record of completed swaps, or by us. It says nothing about the quality of a playlist, and we can withdraw it.

6. Trial, plans and payment

Every new account gets 30 days with the limits of the Pro plan, without giving payment details. When the trial ends the account moves to the Free plan automatically. Nothing is charged unless you choose a paid plan, and nothing you added is deleted: you only cannot add more than the Free plan allows. An email address gets one trial.

Paid plans are billed monthly in advance through our payment provider and renew until cancelled. Prices in US dollars, taxes not included. You can cancel at any time from your profile; access continues until the end of the period already paid for. A change to a more expensive plan is charged immediately for the remainder of the period. Fees already paid are not refunded except where the law gives you that right; if you are a consumer in a country that grants a right of withdrawal, you keep it, and you can exercise it by writing to the contact address above.

If we change a price, we tell you by email at least 30 days before it applies to you, and you can cancel before it does.

Referrals: a member you invite gets the first month of their first paid plan free. You get 10% off one invoice for each invited member who has paid for a plan; credit from several invitations adds up to 100% at most and is used once, by your next checkout. Credit has no cash value.

7. Your content

You keep the rights to what you upload or write. You grant us the licence needed to store it and show it to other members as part of the service.

8. Support access

To help you with a problem, or to deal with a report, our staff can look at your account as you see it, and can list your conversations. Staff cannot change anything in your account from such a session, every access is recorded, and messages are read only when moderation requires it. The privacy policy describes this in more detail.

9. Availability and liability

The service depends on third parties, including Spotify, and may be interrupted or change. It is provided as is. To the extent the law allows, our liability for any claim is limited to the fees you paid in the twelve months before the claim. Nothing in these terms limits liability for intent or gross negligence, or any right the law gives you as a consumer that cannot be waived.

10. Ending your account

You can delete your account from your profile. Your subscription is cancelled, running swaps are ended and your data is removed as described in the privacy policy. Completed swaps stay in your former partners' history without your details.

11. Changes, law and contact

We may update these terms. We tell you about material changes by email or in the app at least 30 days before they apply, and you can close your account if you do not agree. These terms are governed by the law of the country in which the operator named above is established; if you are a consumer, the mandatory protections of the country you live in continue to apply.
